Production draft. Seller-of-record, paid-coaching contracting, governing-law and legal-entity clauses are intentionally not guessed; they must be finalized with the payment architecture.
1. The MHSWE service
MHSWE provides a strength-training ecosystem that can include an Athlete App, Coach Platform, public Coach Directory, Program Marketplace, training/programming tools, analytics and communication features.
2. Accounts
You must provide accurate information, keep your account secure and use MHSWE lawfully. You are responsible for activity performed through your account unless applicable law provides otherwise. MHSWE may take reasonable action to protect the platform, users and payments from abuse or unauthorized activity.
3. Training information
MHSWE provides software and training/coaching tools. Training information available through the platform is not a substitute for professional medical advice, diagnosis or treatment. Users remain responsible for deciding whether training is appropriate for them and for seeking qualified professional advice when needed.
4. Coaches
Coaches using MHSWE may be independent businesses or professionals. The final production terms must clearly state the contractual roles for paid coaching, including who supplies the coaching service, who invoices the consumer and which party is responsible for consumer-law obligations. Those roles will be finalized together with the Stripe Connect payment architecture before paid coaching launches.
5. Programs and Marketplace
Programs may be offered free or paid. Marketplace purchases, ownership, refunds and seller responsibilities are also governed by the Marketplace Terms and Refund & Cancellation Policy.
6. User content
You retain rights you have in content you upload. You grant MHSWE the permissions reasonably necessary to host, process, display and transmit that content to operate the features you choose to use. You must have the right to upload and share your content.
7. Acceptable use
You may not misuse MHSWE, attempt unauthorized access, interfere with the service, upload unlawful or infringing material, impersonate others, manipulate transactions or use the platform to harm other users.
8. Availability and changes
MHSWE may maintain, improve or modify the service. We aim to provide a reliable platform but do not promise uninterrupted availability. Consumer rights that cannot legally be excluded remain unaffected.
9. Suspension and termination
MHSWE may suspend or restrict accounts where reasonably necessary for security, legal compliance, payment disputes, serious breaches or protection of users. Users may stop using MHSWE and may request account deletion subject to data that must be retained by law or for legitimate dispute/security purposes.
10. Governing rights
These terms do not remove mandatory consumer rights. The final governing-law, dispute-resolution and legal-entity clauses will be completed before production release based on the entity operating MHSWE and the markets in which MHSWE launches.
